It is now time to "Kick the tires, and Light the fires, Captain" as they said in the movie Independence Day!
After a year of stalling by Chief Justice George while he shopped for a judge, one was assigned to the cases I had won on appeal. Oral argument is scheduled for August 14th, 2007, in the case of Forte vs. Judge O'Farrell, M72599.
For you new-bies, that's the case Judge O'Farrell assigned to himself. O'Farrell's defense counsel, (then) Attorney General Bill Lockyer, didn't see any problem with it. Get a brain freeze on that one? I filed what is called a Challenge for Cause. Judge O'Farrell then tucked his tail between his legs and ran for cover, instead of filing an answer to the challenge.
I mean what else could he say except, Bye-bye Gene! Of course, he did once say, "Take him into custody!", immediately after I properly served him with a CCP 170.6 Peremptory Challenge. The CCP 170.6 to a judge is the equivalency of a Silver Bullet to a Werewolf.
There is also now pending the appeal in the case of McKee v. Forte, DVH3863. It focuses on the very most basic and important Constitutional right a citizen has. The right to petition government for redress of grievance without threat of arrest.
How much more basic and important can it get?

Not all attorneys, judges and public officials are bad. Now more than ever, the good ones need our help to expose the bad guys and stand up for them as citizens. They cannot do it on their own without being drummed out of the ranks and suffer reprisal.
Sad to say, many of the proffered well-intended and good sounding projects were designed to only pass the public sniff test. In reality they're ripe with low hanging fruit for corrupt public officials and corrupt regulators to pick and line their pockets.
Face it, with the wells running dry from the looting by our public officials they are desperately seeking new targets of opportunity. You, your company, or your employer, could be their next mark. It will trickle down to you.

The primary objective of the judiciary is to uphold the public faith in the judiciary. If that was not done chaos would ensue. Of course, it was really meant to make it so that the actions of our public officials and the judiciary should be beyond reproach
The judiciary and the government has contorted it to mean that in order to achieve such objective it is required of them to conceal public official/judicial corruption from the public at any and all cost. The FBI works under such guideline also. Not to do so would not be holding to the prime objective of maintaining the public trust of the judiciary and in their twisted logic un-American. What started out as a simple purchase mushroomed into an epic adventure. Monterey Public Official/Judicial Corruption Cabal Bubble About To Burst
Monterey Herald, May 28th, 2006, Sunday Front Page Article "Judge Scott Subject of Probe"
On Sunday, May 28th, 2006, The Monterey Herald ran the front page article 'Judge Scott Subject of Probe'. In the same paper there were two other related articles entitled 'Velasquez's style "blunt" on the bench' and 'Judge Moody's comments termed unsettling'.
Seven judges are mentioned that may, or may not be, subject of investigations that are deemed private by the Commission on Judicial Performance (CJP) so the public does not know what is going on, if anything. All of the investigations, in one way or the other, stem directly from the evidence Forte filed in the case of Forte vs. Judge O'Farrell, in November 2005. The evidence was contained in the Powser declaration Forte filed in the case against Judge O'Farrell (M72599) and in Forte's cases against several Monterey attorneys (M58208, M54914).
No where in any of the three articles are either, Forte, Judge Robert O'Farrell or the case of Forte vs. O'Farrell mentioned. How can that be? How can it still be considered balanced and informative reporting? How could it uphold to the ethics of journalism? The answer simply is that it can't! (Continued Inside)
Anti-Slapp Motion Filed Against Monterey County Counsel Charles McKee
On February 16th, 2006, Monterey County Counsel McKee, in order to prevent a lawful Citizen's Arrest according to California Penal Code 837 being effectuated upon him for Misprision of a Felony, filed the lawsuit of McKee vs. Forte (DVH3863), alleging that Forte had made a credible threat of violence against him.
In response to such, Forte filed what is known as an Anti-Slapp Motion claiming that a lawful Citizen's Arrest is not a "credible threat of violence". Enter the website to review the filed court documents and see exactly what Monterey County Counsel McKee says he believes was a credible threat of violence.
